Can a foreign company apply for an SFCR licence to import food into Canada? 

COMPLIANCE ALERT: Foreign companies cannot obtain an SFC licence unless they qualify as non-resident importers. If you have a fixed place of business in Canada, you must apply as a Canadian-based importer even if your head office is outside Canada. 

Yes, but the pathway is specific and most international food brands are not aware it exists. Persons who do not have a fixed place of business in Canada and who qualify as non-resident importers are eligible to apply for an SFC licence for the activity of importing food. This means a food brand based in Barbados, Jamaica, or any other country can hold a Canadian import licence directly without establishing a Canadian subsidiary or legal entity first. 

The non-resident importer designation exists specifically to enable foreign businesses to bring food into Canada on their own licence rather than being entirely dependent on a Canadian importer of record. This gives international food brands more direct control over their Canadian compliance obligations and their supply chain documentation. 

However, if you qualify as a non-resident importer but also have a fixed place of business in Canada, you must apply for your licence as an importer located in Canada. The non-resident pathway is not available to businesses with a Canadian physical presence. 

The non-resident importer licence still requires a full PCP, accurate commodity coverage, and compliance with all SFCR requirements. The designation changes the application pathway, not the compliance obligations. And the same 70-business-day service standard applies regardless of whether the applicant is Canadian or non-resident.
